18th May 2010
Attention: H-1B Hopefuls
As of the 6th of May 2010, the USCIS had received 13,500 petitions toward the 65,000 H-1B visa cap. It’s still not too late to apply!
Understand Visa Rules or Risk Deportation
Each and every day, U.S. papers report on the controversial topic of immigration law and how it is dividing the country. However, it is not only the country being divided, but couples who are being separated, and facing a 10-year ban on seeing each other on United States’ soil. Thousands of immigrants, who are married to U.S. citizens, enter the country on the visa- waiver program, providing them with a 90-day stay in the States. During this time they can file for their green card, and their status should be adjusted to a permanent resident upon acceptance of their application. However, many of them are missing documents in their visa application; during the time it takes to file an adjusted application, the immigrant is beyond the 90-day stay and is now residing in the U.S. illegally. A frequently overlooked provision of the visa waiver program involves foreign visitors giving up any right to contest deportation; thus many foreign spouses are being taken away in handcuffs at immigration authorities’ discretion, and face deportation without even a hearing. Previously, the law was forgiving towards foreign spouses who entered the country legally and allowed them to adjust their status even if they surpassed their 90-day stay. With many states creating stricter laws, there will be hundreds of couples facing separation.
More Issues with U.S. Health Care Reform
Health insurance companies in the United States are no longer trying to fight the health care reform bill, but instead, work around its requirements. Several provisions under the new health care law need rules to define how the law will be implemented. For example, one provision prevents insurance companies from carrying out “unreasonable premium increases” without government officials approving these increases. As the law does not specify how much is an “unreasonable premium increase”, rules need to be written to define this. Another provision mandates that a minimum percentage of premium dollars be spent on real medical costs related to the care of patients. As often, insurance companies hold these premium dollars as profit or to cover administrative costs. Rules that define how these provisions are implemented will mean the difference between insurance companies operating like they used to, or operating under the law as it was supposed to be utilised. Insurance companies are hoping for broad rules to define the provisions, so that there is greater room to operate as they see fit.
Your Green Card Will Actually be Green?
The USCIS, U.S. Citizenship and Immigration Services, announced this week that the Permanent Resident Card has been revamped to include several new high tech features. However, the most obvious new feature is also the least high tech- the new green colouring. The Green Card will finally be in keeping with its nickname and this color will ensure easy recognition. Another new feature of the redesigned Green Card is a preprinted return address to enable the swift return of a lost card. Several of the new high tech features include laser engraved fingerprints, holographic images and high resolution micro-images, which will work to make counterfeiting virtually impossible. A Radio Frequency Identification capability will enable Customs and Border protection officers to read a green card from a distance. The new facets of the Green Card are seen as a major achievement for USCIS and will benefit many people who look to the Green Card for proof of residence and work eligibility. All previous editions of the Green Card will be replaced as individual immigrants apply for replacements or renewal.

26th June 2010 It’s a Buyer’s Market!
As the government’s tax credit has expired, the U.S. housing market has suffered and sales have fallen drastically across the country. Construction of new homes has also significantly dropped since April, causing troubles for builders. While builders and homeowners looking to sell are suffering the brunt of this poor market, people who are willing and capable to buy are overwhelmed with possibilities. Buyers are cutthroat, looking for lower prices, and thousands of dollars in housing improvement before even considering to buy. If a seller counteroffers, buyers simply walk away until they find someone who will agree to their, often irrational, demands. In this market, sales are frequently falling apart at the last minute, as buyers recognise their endless possibilities to attain what they want, somewhere else. So if you have the money and the bargaining tactics, the time to buy is now!
Can You Pass the Test?
For the hundreds of thousands of US citizens each year that petition for their spouse to attain a green card, they prepare for the stressful scrutiny the couple will face in order for immigration officers to determine the validity of their marriage. Couples wait nervously for their appointment with an immigration officer who holds their future in his or her hands. Many hold in their hands proof of their love through email exchanges and joint banking accounts. Often US citizens fear their loved one will be deported from the U.S. without the successful attainment of a green card, as temporary visas will eventually run out. With such high stakes, who wouldn’t be nervous? It is easy to make the simple mistake of forgetting the color of a spouse’s toothbrush, or forgetting the intricacies of a spouse’s favorite meal. However, for the majority of couples, the interview goes well and they breathe a sigh of relief upon hearing their approval. |
