Eb-5 Investment Visa Guide
The Employment Based 5th Preference Visa, or EB-5, is a permanent resident visa based on an investment that provides jobs for U.S. workers and enhances the U.S. economy. The investment is required to be $1 million U.S. dollars or in some less developed areas, $500,000 U.S. dollars. A $1 million dollar investment must provide a minimum of 10 jobs, while a $500,000 dollar investment must provide at least 5 jobs. The investment must also be a direct investment into a business or an investment into a Regional Center approved by the federal government. If an application for an EB-5 investor is approved, then the applicant and family (including unmarried children under 21 at the time of applying) receive conditional visas which are made permanent after two years if the specific number of jobs were produced and the original investment requirements were met and maintained.
An investment into a Regional Center is an investment in an entity or organisation that completed an application process with the USCIS to gain its status of being a Regional Center. These entities promote economic growth through the addition of new jobs, increasing investment, and higher productivity and sales. However, unlike other businesses, Regional Centers have greater flexibility in proving that it creates ten new jobs for their collective investors. While Regional Centers may appear to be a smoother option for foreign investors, not all fulfill EB-5 requirements by prioritising investors’ needs. While a Regional Center is approved, the projects that occur within the entity may not be approved. The tough reality is that not all Regional Center projects satisfy EB-5 guidelines.
